The engagement of services is to conduct a Forensic Voice Stress Analysis on 4 audio recordings to determine if stress is present during the subject’s statements. Categories of stress will be quantified and equated to Deception as protocol dictates.

You see this is the situation. The prosecution has made a syndicate of 4 or 5 witnesses. They will use them. I am one of these people. They even took me to the cantonment.

I spent nearly fifteen hundred thousand taka. Just to survive against the opposite party. I have been through a lot.

How I became a witness? My son got the job of an A.S.P. (Police) as a BCS cadre. But he was about to lose his job for this.

Then I came to an agreement with Tuku. He said”you were a freedom fighter. If you testify the way I tell you then your son can keep his job.

Otherwise, his name came out in Police investigation, you know. They made that son of mine an accused so that he cannot take the job. A lot of terrible things happened to me.

So, once again I was in conflict with Tuku. I couldn’t control my family (to vote for Jamaat). I was away during the election. But people voted Jamaat in the end. They broke my sons arm a couple months after the election.

After that I saw my son got selected for the A.S.P. (Police) job. That was a problem. He was made an accused in a case.

I then surrendered to Tuku.

Please save my son’s job at any cost!

He said he will give my son the job. But I have to be a witness in this case.

I am in big trouble, my son,

I will have to testify. There is no other way. I have the card, its inside (my bag). That Major from DGFY said to me that I must testify.

It doesn’t matter whether you are willing or not. The government is depending on you. You must testify in this case. He said these exactly in this language.

  

I was taken there alone. They took four others later. They weren’t taken to the cantonment.

If I live in this country, I have to testify.

They will pick me up first. They will rehearse me the deposition and then I will have to reproduce that with commas, semi-colon and full stops.

Otherwise the next day the RAB will force me into disappearance too. If I say anything outside their instruction, they will attach me with some cases and arrest me. Their attitude, from my experience of speaking with Hasina. They will stay in power by any means. Even if they have to kill many people they will do it. It’s not quite that stage now, but Tuku counted the money right in front of me, now that I agreed to testify, he likes me now.

So I said to him one day look, Suranjit Sen’s driver was his downfall. So you never know, you cant be too careful.

He said, “I’m the state minister for home affairs, cheer up!

I said there will be consequences.

Auntie (Tuku’s wife) openly takes money.

I’ve never heard Mrs. Abu Syeed takes money. I’ve never heard Mrs. Nizami taking bribe in exchange giving someone a job.

This bad reputation is spreading out uncle.

Tuku organized a lot of this, you would go there and testify in that case, you should say this in his testimony.

  

 

And they took me away in a car. They thought I might flee. They could not believe me!

 

Tuku has a private force like the RAB. His own force. Like Hitler’s fifth force that he used to use for privately; not for the state. They were under Hitler, Goebbels and Robel.

They used to pick up anyone, kill anyone anytime. Tuku has his own force.

Sheikh Hasina said to me that day “We will be in power. We will do that by any means necessary. Then we will go down to the grass root level. We will uproot them totally (Bangladesh Jamaat-e- islami) If I remain alive!

I was in a separate room. There were finance minister, next to him was Sahere Khatun, and next was state minister of law, and me and my wife.

They gave me a pass for my wife as well. I took her. Who will look after her? If I die!

You (Hasina) are making me give false witness, I said to her too. She said, no matter if it is false or true! You have to do it for the country. You will be rewarded for this, she said.

This whole thing was made by the DGFI, They will arrest Ishak Moulana and Sobhan Moulana using this statement.

I knew Ishak is dead, but the paper had his name on it. But he died! They said “No, he is doing business in Chittagong.

  

They typed all of these and I just signed.

I read it. They said you don’t have to read, just sign. Tuku was there, you know the Sathiya Rest House. They called me in the middle of the night.

Mr. Tuku put Rafikunnabi’s name in it. He’s gonna get arrested later. I really fear Minister Tuku. I am targeted. Verify from others whether I was the no. 1 accused of five cases or not.

I was harassed. RAB and police used to come to my residence. But suddenly he .........for home affairs. If he was electricity minister................ Horrible person, He kills people.

He said to me, “uncle I went to do the hajj, but what use is that. I have order killing every day. I don’t know how great this sin is!

I said “it’s the gravest sin”

Hasina said “I judged you wrong. You went to Delhi to see me; she said that in front of those ministers.

You testify and I will reward you personally. I promise you this.

I said “You said this many times before, but you didn’t do anything. You made many people directors of banks and you made many people many things, but did nothing for me.”

She said “your family support Jamaat.” Tuku told her that too.

“You should be grateful that I don’t treat you as a Jamaat supporter” She said laughing. She is duch a jester, Sheikh Hasina.

She said, Go eat something. This time you will be rewarded. You will be given a post somewhere”

But I fear them. They are not humans. They shot seven guys dead. How many mothers have lost their loved ones?

 

 

I said “you will get the return. Your pilgrimage will not help you He said you are right. I have nightmares at night; can’t sleep.

I watch these things happen. The day Zainal Abedin Faruk was beaten I was in the secretariat. He (Tuko) ordered them to beat him. He told them to break his legs. The police beat him severely.

I watch those in his office. IG of police, DG of RAB pay visit to his office, sometime he asks me to leave the room and sometimes I sit on a sofa in the corner of the room. He will be the next chief of army. He is very close to Hasina. He prepared my testimony. He was the head of DGFL.

They made the case in a way so Mr. Nizami can’t get away.

Sheikh Hasina called me with my wife for a meeting on the 4th of last month. My wife said to her “if my husband dies I will curse you.”

She (Hasina) said that I will personally take care of him. She calls me in again.

I testified for a few big reasons. One of those was a 140 million taka loan from ADB.

It is settled. No interests in eight years. It was withdrawn directly from the PM’s office.

Reporter: Now they want the testimony for the loan?

Nannu: Yes. My youngest son is going crazy over this. He had his arm broken for this. Now the loan will be lost. How will I survive?

Nannu: They are using it to get my testimony. If I don’t testify, I wont get it. The loan is conditional. Everything is ready, it’s signed. No interest for eight years.

Because the trial has held, they appointed Toby Cadman as lobbyist to create a chaotic situation internationally. So far all the international controversy related to International crimes tribunal is created by Toby Cadman. I have stated their name when I disposed.

I am Advocate Shamsul Haque Nannu, my address is, village: Choto Pathailhat, P.S. Shanthia, District: Pabna. My father is late Haji Niyamat Ali.

Q: Your occupation?

N: I am a lawyer. I am a member of Supreme Court Bar. I am also a freedom fighter and receive honorarium from the government.

        

Q: What do you know about Mawlana Motiur Rahman Nizami?

N: He was young at that time and was a student [in 1971]. He was not that mature at that time. He is not much older than me. I did not see him during the period of liberation war. I did not see him to do anything neither for nor against our liberation movement. That because I was busy in the battle field and not there. I don’t know actually who burnt my house.

Q: Have you complained against Mr. Nizami for that? N: No. I never complain against Mr. Nizami for burning my house. He was not in Pabna town at that

time. He was not used to live in pabna.

Q: Did you see Mr. Nizami in 1971? N: No I did not see him.

Q: When did you see him for the first time? N: I actually know him from 1986 National election.

      

Q: Was he in Pabna before that? N: No.

N: In Demra. Actually Pakistani Army committed the atrocity. The one, who guided them, was arrested later by the freedom fighters and he was punished in a public court. Thousands of people know that Asad was sentenced to death in that public trial and the freedom fighters executed that. Mr. Nizami, Mr. Sobhan, Mr. Sayeedy or Mr. Golam Azam was not implicated, no one even complained against them. The complain was against Asad, Public complained against him, he was arrested by the freedom fighter, he was sentenced to death and it was executed.

Q: Where was Asad’s residence?

N: Asad used to live in Bera. All the local people know that. There the battle took place in Kaliany village, but someone guided Pakistani army, he was arrested on 18th December. People came to know that he was the culprit, and then the freedom fighters executed his death sentence. The actual name of the village is Kallani but people call that Kaliany. Mr Nizami was not present there during the battle. The person who brought Military there was belonged to intelligence and a Bengali. People arrested him as well and sentenced him death. That was executed in public in the Kaliani Primary school. I cannot remember the name of that person. However, Mawlana Motiur Rahman Nizami did not go to that locality at that time of battle. What I said to Mr. Abdur Razzak Khan (investigation officer of Mr. Nizami’s case)......., I did not say anything against Mr. Nizami, Mr. Golam Azam, Mawlana Subhan. My complain was only against Mawlana Ishaq. He was a minister of Dr. Malek’s cabinet at that time. My house was burnt at that time. Because of that I complained. Apart from that I never complain against Mr. Nizami, Mr. Golam Azam, Mawlan Subhan and Mr. Rafiqun Nabi. I told before Mr. Motiur Rahman Nizami is a well-reputed politician. This case has been filed in order to victimize him.

     

 

Q: You were quoted in the witness statement that on 14th May 1971 AD at morning, after the dawn prayer, for the purpose of arresting freedom fighters, dead or alive, under the leadership of Mawlana Nizami, Mawlan Subhan, 150 Pakistani Army men raided Demra and Bawsgari village. The supporters of Awami league were identified by Mr. Nizami and others and were brutally killed and women were raped. Did you say that?

N: This is not my version. This statement was made up by the investigating officer in order to politically assassin Mr. Nizami, an internationally reputed Islamic Scholar. The investigating officer made this statement, it is not my statement, I am willing to deny this statement in any court, even if it is necessary, I am willing to give written statement, denying such false allegations.

Q. You have said that you know him from 1986 National election? N: Yes, I did not know him before that.

Q. So the statement given in your reference is not yours?

N: This is not my statement. This has been made up to victimize him [Nizami] politically, and my name is falsely used. If it is put up in any court, I will challenge that this is not my statement.

       

Q: In another place, it appeared that you said, while I was engaged in the lebaration war, I came to know that upon the order of Mr. Golam Azam, Mawlana Nizami, Mawlana Subhan and Mawlana Ishaq formed peace committee, Razakar and Albadr forces. Mr. Motiur Rahman Nizami was the commander of Albadr.

N: When I was in liberation war, I never heard that Mawlana Motiur Rahman Nizami was the commander of Albadr. I did not see him at that time. To best of my knowledge, no one in my locality saw him assisting Pakistani army men. No one told that he saw that. I want to say on oath that these are not my words. It was miss quoted. To me, I believe, as a conscious citizen of the country that in order to victimize a political leader the investigating officer fabricated this upon the direction of someone. this is not my statement. If anyone attempt to put this up as my statement in any court, I will challenge that.

        

 

 

 

 

 

 

 

FINDINGS:

During the course of the Forensic Voice Stress Analysis Investigation, I reviewed numerous audio recordings regarding Mr. Shamsul Haque Nannu. Each audio recording was analyzed for a period of seven (7) revolutions with the findings being the same during each revolution. The deceptive stress patterns are included with this report and titled respectively. Each deceptive response has been quantified in a range of 90-98%. It must be noted that protocol dictates that any measurable deceptive stress begins at 80%. The findings are that the measurable deceptive stresses are 10-18% higher than the first point of measurable deceptive stress.

 

 

 

 

 

 

 

 

 

 

 

 

 

Although Mr. Shamsul Haque Nannu is speaking truthful statements in certain areas, he however has made numerous statements that are not truthful.
